TERMS AND CONDITIONS

1. OWNERSHIP

This website (“99 Speed Mart’s Website”) is owned and operated by 99 Speed Mart Sdn Bhd (Registration No. 200001016930 (519537-X)) (or referred to as “99”, “we” or “us”) (collectively the “Platform”).

2. ACCESS & USE

Your access to, and use of the materials contained in this Platform is conditional on your acceptance and compliance with the terms, conditions, notices, and disclaimers contained in this document or elsewhere on the Platform (“Terms and Conditions”). By accessing and using the Platform, you agree to be bound by these Terms and Conditions. We reserve the right to change or modify these Terms (including our policies which are incorporated into these Terms) at any time. You are strongly recommended to read these Terms regularly.

3. REGISTRATION

We collect the details provided by you on registration together with information we learn about you from your use of our service and your visit to our Platform. By using our Platform, you expressly accept and give your unconditional consent that we may use any and/or disclose information about your demographics in any manner which does not reveal your identity for purpose of administrative, marketing, promotional, strategic development, research and customer care.

The Platforms may be used by (i) natural persons who have reached 18 years of age and (ii) corporate legal entities, e.g companies.

4. ORDERS

1. The minimum order value on this platform is RM500.00 and above.
2. The delivery area is currently applicable to KL & Selangor and within 10km distance from our stores.
3. To complete an order, simply follow the onscreen instructions. We only accept local Debit and Credit cards such as Mastercard, Visa or MyDebit for payment.
4. An order is successfully placed when you receive an order code via SMS.
5. Orders cannot be cancelled upon successful placement.
6. We reserve the right to cancel the orders outside of our delivery zones.

5. DELIVERY

For orders more than 0.5 meter cube in volume, we will deliver to your selected address. Confirmed orders will be delivered by the next working day within your selected time slot if the order is placed before 1pm. You shall present a valid order code and shall be available during the selected delivery slot to accept the order. Please note that the delivery location is only applicable to the provided delivery address, corresponding to the same location and/or lorry vehicle floor level where we unload your orders. We will assist in unloading within 30 meters from the unloading area.

In the event you remain uncontactable or fail to receive the Order within ten (10) minutes from the time the order arrives at your delivery location and you wish to reschedule, you need to pay RM30 to reschedule a second delivery attempt. If you fail to accept the order by the second delivery attempt or fail to reschedule the delivery within two (2) days, the system will cancel your order automatically, we will refund to you the amount you paid and a processing fee of RM30 shall be deducted from it. 

If there is an unfortunate event of a delay by our delivery team, we will reschedule or rearrange the delivery. If you wish to cancel the order in this event, we will refund 100% of your payment to you.

6. IN STORE COLLECTION

Alternatively, for orders less than 0.5 meter cube in volume, you may self-collect at our store daily from 6pm to 10pm upon receiving a notification of your order is ready for pick-up. Should you fail to collect the order within two (2) days, your order will be cancelled automatically and processing fee of RM30 will be deducted from your refund amount.

7. ALCOHOLIC OR NON-HALAL PRODUCTS 

Some of the products featured on our website are subject to restrictions for purchase depending on the applicable laws, including alcoholic or non-halal products. The sale and use of alcohol or non-halal products showcased on this website are restricted to individuals meeting the age requirement of 21 years old and above and/or belonging to the category of non-Muslim consumers only.

8. INTELLECTUAL PROPERTY

The content displayed on the Platform is protected by copyright, trademarks, database and other intellectual property rights. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior express written consent.

9. REPRESENTATIONS AND WARRANTIES

You acknowledge and agree that the content on the Platform are provided on an “as is” and “as available” basis, and that your use of or reliance upon the Platform and any content, goods, products or services accessed or obtained thereby is at your sole risk and discretion. While we will make reasonable efforts to ensure the provision of the Platform and the services we offer, are available at all times, we do not warrant or represent that the Platform shall be provided in a manner which is secure, timely, uninterrupted, error-free, free of technical difficulties, defects or viruses. Please expect temporary interruptions of the Platform due to scheduled or regular system maintenance work, downtimes attributable to internet or electronic communications or events of force majeure.

10. LIMITATION OF LIABILITY

To the extent permitted by law, 99 Speed Mart Sdn Bhd (which shall include its employees, directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for any loss or damage which you or any third party may incur in connection with our Platform, our services, and any website linked to our Platform and any content or material posted on it.

11. THIRD PARTY LINKS AND WEBSITES

The Platform may contain links to other third-party websites and by clicking on these links, you agree to do so at your own risk. We do not control or endorse these third-party websites or links and shall not be responsible for the content of these linked pages. We accept no liability or responsibility for any loss or damage which may be suffered by you in relation to your access and use of these third-party links and websites.

12. GOVERNING LAW AND JURISDICTION

The terms and conditions herein shall be governed by and construed in accordance with the laws of Malaysia, and you shall submit to the exclusive jurisdiction of the courts of Malaysia.

RETURN, EXCHANGE, CANCELLATION POLICY

This Policy is designed to protect our Customers against unsatisfying or damaged Products by offering a refund or exchange based on our Customers’ preferences upon mutual agreement meeting the return term and conditions once the Products have been delivered to the Customers after purchase from the Platform. Any return, exchange or cancellation of Products by Customers shall be governed by and subject to the terms and conditions set out under this Policy. This Policy may be revised from time to time at the discretion of the Company.

1. TERMS OF EXCHANGE OR RETURN

This Policy is only applicable if the Products that you wish to exchange, or return are purchased from the Platform. Purchases via other means will not be eligible for this Exchange & Return Policy. This policy does not apply to Products that have been categorized as non-exchangeable or non-refundable. Upon receiving the goods from our delivery team, if the purchased product is defective, you may within five (5) days bring along the original receipt of the order and head to the nearest outlet to exchange or return the product.

2. CANCELLATION POLICY

Please note that there shall be no cancellation once the order has been placed. A processing fee of RM30 will be charged if customer is not present to receive the order, and no requests have been received by the end of the next day.
